At their May 8 board meeting, the Peyton Fire Protection District postponed the public hearing to exclude a portion of the Santa Fe Springs development from the Peyton fire district.Bob Joly, board president, said the public hearing, which was supposed to be held as part of the board meeting on May 8, was postponed because the developer of Santa Fe Springs, Ray OíSullivan, and the board have not resolved the issue of who should pay for the districtís legal fees.Joly cited Colorado Title 32-1-501, which governs the procedures that allow property owners to petition special districts like the Peyton fire district for exclusion. The statute says, ìThe petition [requesting an exclusion] shall be accompanied by a deposit of money sufficient to pay all costs of the exclusion proceedings.îAccording to the districtís budget as of April 30, the cost of professional services, including legal fees, exceeds the amount budgeted for the year by $1,101.43.The board rescheduled the public hearing on this matter for June 12.
